Two buyers of the iPod filed a case in 2006 claiming that the sound of the iPod can reach a maximum of 115 decibels enough they say to cause permanent hearing loss. The device's ear buds provide less protection that traditional head phones the suit alleged and the volume switch failed to notify users of dangerous levels. The plaintiff's also claimed that the manufacturers warning which cautions users was inadequate and not enough. The suit also alleged that consumers overpaid for the device.
In the ruling the judge wrote that the plaintiff's did not offer any proof that they hearing has been damaged or that iPod's ear buds are dangerous but only pointed that they could be made safer.
So for now Apple is out of the court getting ready for the next set of allegations, they always come.
